Mackenzie Alpine Horse Trekking Limited (“the Company”) requires every person who participates in one of the company’s horse treks to sign this form before commencing the trek.

RELEASE AND WAIVER OF LIABILITY
WARNING: Under New Zealand law it is unlikely that you will be able to sue anyone if you are injured. New Zealand Accident Compensation Scheme provides limited assistance for injury. Visitors to New Zealand are strongly recommended to have full insurance covering injury and illness before participating in one of the Company’s horse treks.
I hereby affirm, acknowledge and understand –
• There are SUBSTANTIAL RISKS involved in horseback riding which include but are not limited to, severe injuries resulting in permanent physical disabilities, bone and joint injuries, muscle strain and muscle injuries, brain injury, neurological damage and death. Horses can be of an unpredictable and they may react to the conduct and actions of other riders and persons. Horses may, without warning , kick, bite, baulk, stomp, stumble, rear, bolt, fall down and react to sudden movements, noises, vehicles, other animals, or objects.
I hereby acknowledge and accept that –
• While the company and its staff will use a high degree of skill in ensuring the safety and welfare of participants, it will not accept liability for loss, injury, damage or disruption by me or my dependents.
• I Must Follow the instructions of the Company and its staff at all times. If I am responsible for a person under the age of 18 (a dependent), I must ensure that any dependent also follows instructions.
I release and indemnify the Company and its staff –
• From any liability for loss or damage to my property, physical or mental injury sustained by me, or disruption to my travel plans which may result from my participation in a horse trek, regardless of how the situation may occurs.
Please note: This exclusion of liability operates to the extent permitted by law subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.
• Against any liability they incur to anyone else resulting from my failure, or that of a dependent, to follow the instructions of the Company and its staff.
I accept that the Company and its staff reserve the right to withdraw any person from the horse trek who in their opinion is likely to endanger themselves or others and cancel the horse trek if they become concerned for any reason for my safety or that of any other person.
